CONTEST STATUTE "Dr. LUCULLUS MEGA CONTEST"

1. Subject and purpose of the statute

The subject of this statute is the regulation of the contest conditions of the "Dr. LUCULLUS MEGA CONTEST" (hereinafter referred to as "contest"), whose participants, who participate in the contest and become winners under the terms of this statute, can win prizes as specified below in this statute.

2. Organizer of the contest

The organizer of the contest is the company:

(hereinafter referred to as the "contest organizer"). The organizer is also the provider of the prizes for the contest.

3. Providers of contest prizes

4. Conditions of participation in the contest

Any individual or legal entity can participate in the contest and become a winner if they:

are an EU citizen or have permanent or temporary residence/company headquarters/place of business within the EU;
meet the conditions of this statute;
agree with the provisions of this statute;
are of legal age.

Employees of the contest organizer, as well as persons related to them (in accordance with the definition of § 116 of the Civil Code – the part of the sentence before the semicolon), are not allowed to participate in the contest. If it is proven that the contest winner is such a person, the contest organizer may exclude them from the contest, resulting in the loss of entitlement to the prize, which will not be handed over and will remain available to the contest organizer.

By entering the contest, participants express their agreement with the contest rules and this statute.

5. Start and end of the contest

Participants can enter the contest between 1.9.2024 and 31.3.2025 (hereinafter referred to as the "contest duration").

6. Place of the contest

The place of the contest is the territory of the Slovak Republic.

7. Conditions and course of the contest

Participants can enter the contest during the contest duration specified in point 5 of this statute by purchasing any Dr. LUCULLUS product either online at drlucullus.sk, drlucullus.cz, drlucullus.de, drlucullus.com, or from a partner offering Dr. LUCULLUS products. Each participant can be entered into the draw multiple times, earning one raffle ticket for every full 1€ spent, thus increasing their chances of winning.

The competition will end on 31.3.2025 at 23:59:59. The winners will be drawn by random selection by the competition organizer or a person authorized by them from among all participants.

The participant acknowledges that the competition organizer does not process personal data of participants who do not become winners according to these competition rules.

8. Prizes, announcement of winners, and prize distribution

The prize winners will be determined by random selection from the list of contest participants who have validly entered the contest and meet the conditions for being included in the draw.

The contest prizes are as follows:

1x new Peugeot 208 worth 14,990€ including VAT
3x exotic all-inclusive vacation from Travelco (Dominican Republic, Cuba, Vietnam worth 2,000€ including VAT)
10x Dr. LUCULLUS vitamins for the whole family worth 100€ including VAT
15x TAMI product packages worth 50€ including VAT

The winners will be published on the websites drlucullus.sk, drlucullus.cz, drlucullus.de, drlucullus.com, and the winner will be notified via email or contacted via their phone number.

This notification will also include instructions on how the prize can be claimed, consent to the processing of the winner's personal data, and information about data protection. If the winner does not claim the prize within the deadline specified in the prize notification or waives the prize, or fails to meet another condition according to these rules, they lose the right to the corresponding prize and have no claim to any substitute.

If it is not possible to contact the winner and the winner does not respond to the competition organizer within 48 hours from the time they were first contacted via email, they lose the right to the prize and the prize will be awarded to the drawn alternate.

The prize will be sent to the winner by post to their address. The competition organizer reserves the right to change the method of prize delivery.

Prizes from the competition are subject to income tax in accordance with the Income Tax Act No. 595/2003 Coll. on Income Tax as amended (hereinafter "Income Tax Act") and the winner is obliged to follow this law when taxing the prize. Prizes received by the winner are before tax. According to the Income Tax Act No. 595/2003 Coll. as amended, prizes from the competition not exceeding 350 EUR are exempt from tax. The prize delivered to the winner is before tax and the competition organizer is not responsible for any tax obligations arising from the acceptance of the prize by the winner.

The prize in the competition is not enforceable by law. The prize cannot be exchanged for cash. In case of any doubts about compliance with the competition rules, the competition organizer will decide on the further course of action.

9. Rights of the contestant as a data subject

By entering the contest, the contestant voluntarily provides their personal data during the contest period and the publication of results for the purpose of contacting them in the event of a win, delivering the prize to the winner, and announcing the win on the organizer's websites drlucullus.sk, drlucullus.cz, drlucullus.de, drlucullus.com.

10. Final provisions

The statute of this contest will be available on request from the contest organizer and on their website: drlucullus.sk, drlucullus.cz, drlucullus.de, drlucullus.com. The contest organizer reserves the right to shorten the contest, suspend it, or change the rules. Any changes to the contest rules will be announced on the website.

The provisions of this statute become valid and effective upon publication on the website.

The participant agrees to provide truthful information and to comply with the conditions set forth in this statute. The participant agrees that by participating in the competition, they have not and will not violate any generally binding legal regulations or the conditions set forth in this statute.

The participant acknowledges that when using websites and servers in connection with the competition, they must not behave contrary to the generally binding legal regulations of the Slovak Republic and/or contrary to good morals, and they must not take any actions that would prevent or attempt to prevent other competitors from participating in the competition or that would threaten or disrupt the competition. The participant must not harass other competitors.

Each participant assumes responsibility for using the websites and declares that by agreeing to this statute, they undertake that their participation in the competition will not violate any generally binding legal regulations or competition conditions. This responsibility is not assumed by the administrator, the domain owner, the hosting provider, the server owner, or the internet provider.

Each participant agrees that they will not in any way harm other competitors or third parties, nor violate the conditions set forth in this statute. If this condition is violated, the competition organizer is entitled to exclude the participant from the competition.

The participant agrees that their conduct will not disparage, ridicule, or otherwise harm the interests of the competition organizer or their good reputation, and they must not promote the services of other persons who are in direct or indirect competition with the competition organizer. If this condition is violated, the competition organizer is entitled to exclude the participant from the competition.

Each participant is fully responsible for their actions related to the competition. The participant acknowledges and agrees that the competition organizer is entitled to modify the provisions of this statute at any time or cancel the competition at any time. In the event of a change to the statute, the participant acknowledges and agrees that the most recent version of the statute will always be valid and effective. The competition organizer is not obliged to inform participants of rule changes, as the current valid and effective version is always published on the website.

The participant agrees to comply with this statute, the instructions of the competition organizer, and other persons involved in the competition; their decisions will be final and binding on all participants in all matters relating to the competition. The competition is governed solely by the statute, which regulates the rights and obligations of competitors, their responsibility, and its rules.

No participant is entitled to win unless they agree to this statute and fulfill the obligations arising from it. The participant is also not entitled to a prize if they do not meet the competition conditions. Legal relations not regulated by this statute are governed by the legal system of the Slovak Republic, and the participants agree to abide by it.

The competition organizer and the persons performing activities for the competition are not responsible for any technical problems or failures, for the prize, its quality or workmanship, or any other damage or errors arising in connection with the competition, nor for hardware or software errors, faulty internet connections, or any restrictions on internet access, the server, or for the total or partial unavailability of social networks for any reason, for internet overload, or for unauthorized human or other intervention in the competition process.

The competition organizer reserves the right to assess the fulfillment of all competition conditions by participants and also reserves the right to (i) exclude a participant from the competition for non-compliance with any of them, (ii) deny the prize entitlement; this also applies if any non-compliance is discovered later (after determining the winner in accordance with these rules), but no later than the moment of prize delivery or redemption.
